These general terms and conditions govern the relationship between SHIFTSCHOOL and the Participant (as defined below) with respect to the procedures involving registration and deregistration for all programs and services offered by SHIFTSCHOOL GmbH (hereinafter SHIFTSCHOOL). Our offers, services and deliveries are made exclusively on the basis of these General Terms and Conditions. Terms and conditions of the participant shall not apply.

The Terms & Conditions may be subject to change from time to time, this page always displays the latest update. In addition, please also read our Privacy Policy.
1. Subject matter of the contract
Prices, quotations and descriptions quoted or mentioned do not constitute an offer and may be withdrawn or modified by SHIFTSCHOOL at any time prior to express acceptance of your registration.
The subject matter of the contract is the implementation of the respective agreed program or the respective agreed training/consulting activity by SHIFTSCHOOL. Your application can be made by mail or e-mail. We process applications within 14 days. If we accept you into the course or program, you will receive a confirmation stating the booked program/service. The confirmation can also be done by mail or e-mail. You will also receive a detailed invoice for the amount of the fees. Only with the confirmation of registration the contract comes into effect. The contract is concluded with the Participant. If the Participant is not the registrant, he/she does not become a contractual partner.
2. Payment modalities
The prices/fees are generally due for payment in full before the start of the program. However, we also offer payment by installments upon request. The corresponding modalities will be discussed individually.
The registration to a SHIFTSCHOOL program is binding. As an Participant, you are personally responsible for the cost of the course (local VAT may apply). A seat in the course is not guaranteed until the course fee is paid. The fee must be paid in full no later than 14 days after the invoice date or 2 weeks before the start of the course (whichever is sooner). Seats in a program are bound to a person and cannot be transferred to other persons.
3. Right of Withdrawal
You have the right to withdraw from this contract within 14 days without giving any reason.
To exercise the right of withdrawal, you must inform us (SHIFTSCHOOL GmbH, Sommerstraße 8, 90762 Fürth, Germany, start@shiftschool.de) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by mail or e-mail). To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Effects of withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you, without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.
Regardless of the general right of withdrawal, we grant you the following contractual right of withdrawal: You can withdraw from the contract in text form up to 4 weeks before the start of the program. 10% of each course fee is considered a registration fee and is non-refundable.
4. Cancellation
If you need to cancel your registration, the following terms apply:
Between registration and 2 weeks before the start of the course, 50% of the total fee will be charged. Less than 2 weeks before the start of the course, 80% of the total fee will be charged. After the start of the course cancellation is no longer possible. Exceptions are made for illness proved by a doctor’s certificate. In this case, the participant can transfer to another program at a later date.
5. Program adjustments and cancellation by SHIFTSCHOOL
SHIFTSCHOOL names trainers and specific program items to illustrate the program. There is no claim to exactly these trainers and units.
SHIFTSCHOOL is entitled to adjust the program at any time, as far as this is
acceptable for the Participant; acceptable are in particular changes in content which do not affect the learning objectives significantly. Dates will only be postponed to the extent that this is acceptable for the Participant; This is particularly the case if coaches are unavailable through no fault of their own (e.g. sickness). If a change of venue must be made, it will be announced at least one week prior to the event.
We reserve the right to cancel a course due to low enrollment up to 14 days before the course starts. In the event of cancellation, fees already paid will be refunded; further claims (reimbursement of travel and accommodation costs, loss of work, etc.) are excluded.
6. Disclaimer
SHIFTSCHOOL shall be liable in accordance with the legal regulations: in case of intent and gross negligence as well as injury to life, body life, body and/or health, in case of fraudulent intent, the violation of an assumed guarantee and for claims according to the German Product Liability Act.
For other cases applies: In case of slight negligence SHIFTSCHOOL shall only be liable if an essential contractual obligation (cardinal obligation) is violated or in case of delay or impossibility. In case of liability due to slight negligence, this liability is limited to such damages that are typical for the contract and are foreseeable.
7. Information and Data
SHIFTSCHOOL processes the Participant’s data for the fulfillment of the contract, i.e. to send study materials, to organize participation in the events and to prepare the content of the events and to enable coaching. If the Participant is also the registrant, the processing is based on the fulfillment of the contract, if the persons are different, the processing of the Participant’s data is based on the legitimate interest.
The data will also be disclosed to the trainers for the aforementioned purposes, insofar as this is necessary for their preparation and/or the conduct of training. Likewise, the data will be passed on to the coaches, as far as they need them to fulfill their function. Otherwise, the data will only be processed by us and our order processors and will not be passed on to third parties. You can find more information in the privacy policy.
For some units of the training it is necessary to take photographs, videos and possibly other recordings. These are necessary for the work in the training, but the trainers will try to consider the wishes of the participants. Any use beyond the scope of the training will only be made with the consent of the recorded persons.
8. Rights of use
The content offered, regardless of whether it is user content or educational content, may only be used and viewed by registered Participants for their own purposes. Downloading outside the channels offered by SHIFTSCHOOL, passing on content and teaching materials or even filming the webinars is not permitted, regardless of the purpose.
The Participant grants SHIFTSCHOOL the exclusive right to use the project and practical work free of charge. The personal copyright remains unaffected. Any use by the Participant requires the prior consent of SHIFTSCHOOL in text form.
9. Applicable law
The contract is subject to German law. In the event of differences of opinion and disputes arising from this contract, SHIFTSCHOOL asks you to contact us for clarification. If you are a freelancer or resident abroad, Nuremberg shall be the sole place of jurisdiction.
